1. Acceptance of terms
By creating an account on TutorBill ("the Service", "we", "us"), you ("the User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and TutorBill.
2. Description of service
TutorBill is a lesson management and invoicing platform for tutoring businesses. It allows tutoring business operators ("Administrators") and their tutors to log lessons, manage students, generate invoices, and produce financial summaries.
TutorBill is a tool. The accuracy, completeness, and legality of all data entered — including student details, hourly rates, lesson records, parent email addresses, and ABN — is entirely your responsibility.
3. Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use TutorBill. By registering, you represent that all information you provide is accurate and that you have the authority to operate the business in whose name you register.
4. Your responsibilities
- You are responsible for the accuracy of all data entered into TutorBill, including student names, parent emails, and invoice amounts.
- You are responsible for ensuring you have the legal right to share student and parent data with TutorBill (e.g. parental consent where required).
- You are responsible for verifying that invoices sent via TutorBill are correct before they are sent. TutorBill sends invoices automatically upon lesson logging — you should review your student records and rates regularly.
- You must not use TutorBill for any unlawful purpose or in a way that violates any applicable law or regulation.
- You are responsible for maintaining the security of your account credentials. Notify us immediately of any unauthorised access.
- You must not attempt to circumvent, hack, or reverse-engineer any part of the Service.
5. Limitation of liability

TutorBill provides a software tool. We are not a financial adviser, tax agent, or accountant. We are not responsible for errors arising from incorrect data you enter.
To the maximum extent permitted by applicable law:
- TutorBill is provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not guarantee uninterrupted, error-free, or secure access to the Service.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost revenue, lost profits, or reputational damage arising from your use of the Service.
- Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the total fees paid by you to TutorBill in the 12 months preceding the claim, or AUD $100, whichever is greater.
- We are not liable for failures caused by third-party services (Xero, Resend, Supabase, Vercel) that are outside our control.
6. BAS reports and tax — not advice
TutorBill may display BAS (Business Activity Statement) summaries based on invoice data in the system. These summaries are provided for informational purposes only and do not constitute tax advice.
You are solely responsible for:
- Verifying BAS figures against your own records before lodgement with the ATO
- Ensuring GST calculations are correct and appropriate for your business circumstances
- Lodging correct and timely BAS returns with the ATO
- Seeking advice from a registered BAS agent or tax professional
TutorBill is not liable for any ATO penalties, interest charges, or other consequences arising from incorrect BAS lodgements, even if the error originated from data displayed in TutorBill.
7. Invoice delivery
TutorBill sends invoice emails to parent/guardian email addresses stored in your account. We make reasonable efforts to deliver these emails reliably, but we cannot guarantee delivery. We are not liable for:
- Emails delivered to spam/junk folders
- Failed deliveries due to incorrect email addresses you have entered
- Deliveries delayed or blocked by recipient email providers
- Financial loss resulting from an invoice not being received
8. Plans, payments, and cancellation
TutorBill offers a free plan and paid plans (PRO and MAX). Paid plan pricing is listed at tutorbill.com/pricing.
- All prices are in AUD (Australian dollars) and are exclusive of GST unless stated.
- Subscriptions are billed monthly. You may cancel at any time from your account settings.
- Upon cancellation, your account reverts to the free plan at the end of your current billing period. No refunds are issued for unused portions of a billing period.
- Founders Deal rates ("locked in for life") are honoured as long as your subscription remains active and uninterrupted. Cancellation forfeits the founders rate.
- We reserve the right to change pricing with 30 days written notice by email.
9. Data ownership
You own all data you enter into TutorBill. We process it on your behalf to provide the Service. We do not claim ownership of your business data, student records, or invoice history.
Upon account deletion, you may request a data export before closure. After deletion, we will delete your data within 30 days, except where we are legally required to retain financial records (see our Privacy Policy).
10. Service availability
We aim to provide a reliable service but do not guarantee any specific uptime or availability. TutorBill may be temporarily unavailable for maintenance, updates, or reasons outside our control. We are not liable for any loss resulting from service downtime.
11. Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Use the Service for fraudulent, illegal, or abusive purposes
- Fail to pay fees on your account
You may terminate your account at any time via account settings or by contacting us.
12. Intellectual property
All software, design, and content comprising TutorBill (excluding your data) is owned by TutorBill or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written consent.
13. Changes to terms
We may modify these Terms at any time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms or your use of TutorBill will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
